Small and Micro Entity Voodoo

We All Love Discounts Don't We?

Especially if you are a funds strapped inventor, university, professor, or small business.

We have long felt that one of the best ways to figure out what's going on with patents held by independent inventors; small businesses, under 500 employees - small but not really small; and non-profit organizations, universities, research institutes, organizations focused on research for particular diseases; is to watch their status information and assignee data.


  • Has the assignment information on the patent changed?
  • Is there security lien on the patent?  This usually means someone thinks the business is worth making an investment in and is looking at the patent as collateral.
  • Has their entity status changed from Small or Micro Entity status to Large Entity status?
We make the argument that patentistas - patent attorneys, agents, patent licensing people, are serious enough about their patent assets and those of the clients they support to be careful about how they claim their status. USPTO frowns on not being truthful in your dealings with The Office.  Falsely claiming small entity status and not paying the right fees could render your patent invalid.  So, as a rule, people follow the requirements in their Oath paperwork.  Besides, if you have a hot property that someone wants to license, you aren't going to deliberately establish the wrong entity status to save $1,000 and mess up the revenue gravy train.  But there are those out there who disagree with us, mostly because they don't understand the process.

So...

We wrote up how the process works, inserted a little USPTO MPEP head exploding patent mumbo jumbo, and created a timeline so that you can understand how the whole thing works.   We added a bunch of links to the bills, and other statutory stuff so everything is in one place.  And for you fans of public science and Bayh-Dole, the whole maintenance fee regime started with Bayh-Dole and went on from there. Innovation Business Intelligence

Patents and published patent applications are one of the only publicly available sources of concise scientific information on the output of research and development, the potential use of the inventions, and new product design features. 

If you want to have a deep understanding of the direction of science, technology, and engineering, read patents.  If you don't want to read all of the arcane patent, try the way we read patents to see what they are about.  You don't have to read all of the details to understand the essence of a new invention and where it fits into the world of innovation.  

Each week we publish weekly state-by-state digests about all of the new patents granted that week, the inventors responsible for them...all of the inventors not just the first named inventor on a patent.  This will help you know when local companies and inventors are granted patents. It will help you know which companies are local and which companies are around the company that are working with local inventors.  

So what do you do with this information?  Find investment and partnership opportunities. Know what is happening in your technology parks. This Drives Marketing People Nuts

Today the IBM Watson folks announced establishing a Watson Health Cloud to dramatically advance effectiveness and quality in personal health care, working with Apple, Johnson & Johnson and Medtronic to get the HIPAA-enabled system up and running.  An innovative blockbuster collaboration.

Pfizer.  Not J&J, Apple, IBM or Medtronic.  This must drive the marketing people crazy.  The marketing people in Armonk, New Brunswick, Cupertino, and Minneapolis (and Dublin) are probably not pleased.

Oh...and my male colleagues inform me that these cute blue pills are Viagra.  You can't make this stuff up.

The Collaboration Maps are really interesting.  There are two for each state, one that shows inventors and one that shows assignees.  It helps you understand "cross-border" innovation, who is working with who and where.  The US map highlights the State and then shows the density of inventors or assignees working with their colleagues in that state.

How The Maps Are Organized
There is a map for each state. To support integration of a wide range of economic and business data, we arrange our geographic data using the geographic groups defined by the US Census Bureau and the National Science Foundation.

Buying a Molecule, Mining for Nanoparticles

Yesterday's  AbbVie announced that it was purchasing Silicon Valley based Pharmacyclics for a vertigo inducing price of $21B.  There was lots of speculation that that AbbVie is was filling its product pipeline was its patent for the anti-inflammatory drug Humara is losing its patent protection next year.  

The abstract is that AbbVie gets Imbruvica, one of the world's best selling cancer drug.  The best quote in the coverage explaining what Pharmacyclics was and why it was worth $21B was this one,

"It bought the molecule that became Imbruvica during a fire sale by gene-sequencing company Celera Genomics in 2006."

Buying a molecule.  A patented molecule.

Along the line of really tiny stuff you need a really powerful microscope or a really vivid imagination to see, this week a new patent in the nanomedicine space was awarded to the Colorado School of Mines.  Yes, that is correct, the Colorado School of Mines. US Patent  8,968,705 was granted on Tuesday.


Gold Nano Particle

Gold nanoparticles (GNP) are really good contrast agents for CT and MRI diagnostic imaging improve contrast.    GNPs could be useful in the field of molecular imaging to give in vivo information on the metabolic activity of cancer and the expression of molecular markers, or in normal speak, these little particles can find their way to cancerous tumors so the clinicians on the outside can figure out that's going on in there.  GNPs may also be great for drug delivery and treatment at the molecular level.

The Patentista on the New Innovator's Dilemma

The Patentista decided we needed a coffee and the usual home/office brew wasn't going to work so a walk to the nearest espresso emporium was in order.  The Patentista likes being around the freelancing denizens of the Laptopistan viewing them as figuring out the next big thing.  Folks with the next big thing usually need someone who knows a bit about intellectual property at some point.  A good thing for the Patentista.  After getting settled in among the throng of connected folks, the Patentista related a recent conversation had with a leading computer scientist and some technology transfer types on the new innovator's dilemma.

The computer scientist was worried.  It seems that many of his most talented students and protégés were not executing on their innovations or their talent.  It seems that several forces are at foot.  First there is the matter of student loans.  The young and naive and their aspirational parents felt it was worth going out on a limb financially to make sure that their kids could go to school.  As the loans were mounting, no one realized that every $4.35 latte paid for with student loan money was going to have to be paid back from future dollars with lots of interest on top.  The parents and the students never sat down and figured out what the monthly payment was going to be when the budding computer scientists graduated and went into the workforce.  These loans cost serious money on top of housing, food, healthcare (even on the parents plans), and living expenses.  When faced with the after graduation choice of joining a starving entrepreneurial venture where there risk and rewards for success were high along with the potential that the whole thing would implode and the payroll checks might stop versus a more stable corporate gig, only those students with financial resources could take a risk on the risky venture.  (The Patentista pointed out that not all start-ups have venture capital money behind them from Kleiner Perkins Caufield & Byers.)  So the potential innovators were buried somewhere.  While there was the potential that they would use their skills in corporate America, the odds of a truly disruptive invention coming from that locale was slim.  A least not anytime soon.

Then their is the university spin-out entrepreneurial adventure.  Few of the innovations created by leading graduate level engineering and medical program were making it to the commercialization phase.  The program, designed to have engineers and doctors spend a year in each other's shoes figuring out technical ways to solve pressing medical problems and how to instill medical approaches to engineering had a serious entrepreneurial element.  Identify a compelling project.  Write up the business plans.  Do the research to see if the invention is patentable, figure out all the FDA and other regulatory issues that would impact commercialization, figure out how to make it and support it.  The folks at the university also found this troubling.  But what was up here?

It turned out that the program was expensive.  Even with a scholarship, most of the participants were already in their mid-20s by the time they started and finished the year long adventure.  At the end of the program there was tremendous pressure from parents and the looming student loans to "get a real job."  Because the program didn't have a path that included helping the participants actually get their business up and running or provide funding for salaries post-completion (the participants had graduate stipends while they were in the program) as the program came close to an end, everyone was job hunting.  The Patentista rued the lost potential of those innovations which might just sit in some university repository but never get taken out for a real trial run to see if they were viable.  Again a situation where economic pressures and fear of the marketplace was hindering innovation.  While the university could license the technology, it wasn't the same as having the minds who created the technology finish the job.

The conversation moved on.  Instead of the people working in Laptopistan, what about the folks behind the espresso machine?  The Patentista asked a simple question, "how many of these baristas have more than one job?"  The answer was pretty easy - most of them.  The digital videographer and technologist with great ideas is working on her new technology/videography projects as a stinger for a leading newspaper.  They kind of get her work but are more interested in her superior editing and content skills.  She gets a small fee, the use of their equipment, and the ability to create her own YouTube channel to showcase her work. (They are generous with the shared copyright.) After that almost 30 hour gig, she does another 20 hours foaming milk and making coffee drinks because, well, she needs the insurance.  So after two jobs and 50 hours a week or more of work, there is little time for developing her own work or saving enough money to start her own firm.  Same with the firmware designer-barista who has figured out a new way to stop hackers, or the anime artist with ideas about new ways to use avatars in commercial advertising.

Not everyone can pick up and move to Silicon Valley.  People have to pay their bills and fix their cars, and pay their student loans.  And the universities are not much help.  They aren't setting expectations on the economics of getting a new millennium college degree or the impact of staying in college for six years instead of four.  And these are the kids getting the science and technology degrees.  What about the art majors?

The same is true for technology programs away from major hubs where economic development gurus ask the question, "how can we get these kids to stay here and develop their ideas?"  Same story - even though there is an ample supply of old brick buildings with lots of high speed internet and other resources, the young scientists and technologists have to go where the jobs are.  The Patentista fears that the best minds might be doing identify management in the server room of some big company.

The Patentista and the computer scientist are chagrined.  How can we nurture the next generation of innovators if everyone is making coffee, working two jobs, worried about their student loans and getting healthcare once they turn 27, and getting heat from their parents to get a "real job." (A real concern for patents in these challenging economic times.)  What we need is for the ideas to fly, for these people to do their own thing, to innovate.  After all, a social media search engine optimization wasn't even a job 10 years ago.  (And, the Patentista, always the realist, noted that these are the future clients.)  These people are in their prime - now is the time.

So there it is.  The new innovators dilemma.  How to we free them up so that they can innovate?  It's going to take a lot more coffee to figure that one out.

Innovation – Greater Than The Sum Of Parts

The definition serves as a useful way to frame and ponder inventions that are awarded patents. In the current US patent system, according to the US Patent Office,
A patent is a property right granted by the Government of the United States of America to an inventor “to exclude others from making, using, offering for sale, or selling the invention throughout the United States or importing the invention into the United States” for a limited time in exchange for public disclosure of the invention when the patent is granted.
The USPTO further defines what can and cannot be patented:
What can be patented – utility patents are provided for a new, nonobvious and useful:
  • Process
  • Machine
  • Article of manufacture
  • Composition of matter
  • Improvement of any of the above
  • Note: In addition to utility patents, encompassing one of the categories above, patent protection is available for (1) ornamental design of an article of manufacture or (2) asexually reproduced plant varieties by design and plant patents.
What cannot be patented:
  • Laws of nature
  • Physical phenomena
  • Abstract ideas
  • Literary, dramatic, musical, and artistic works (these can be Copyright protected)
  • Inventions which are:
    • Not useful (such as perpetual motion machines); or
    • Offensive to public morality
And finally, inventions must also be:
  • Novel
  • Nonobvious
  • Adequately described or enabled (for one of ordinary skill in the art to make and use the invention)
  • Claimed by the inventor in clear and definite terms.
What are some of the characteristics of successful innovators? Inventor’s Digest lists 10 qualities identified by Lodestar:
  1. Persistence
  2. Passion and intellectual curiosity
  3. Independent minded, willingness to go against the grain
  4. Ability to recognize and combine patterns into new ideas
  5. Intuitive yet analytical with an ability to understand and interpret business data
  6. Ability to “sell” ideas and concepts
  7. Focused on the future
  8. Ability to draw on wide networks for perspective, advice and accomplishing tasks
  9. Tolerance for risk and ambiguity
  10. Willingness to fail and learn from failure
Artists, writers, and musicians share these traits. An excellent visual example of synergy, and the results of innovative qualities in a person is found in a video describing the re-creation of the poster that inspired John Lennon to write “Being for the Benefit of Mr. Kite” from The Beatles Sergeant Pepper’s Lonely Hearts Club Band album released in 1967. This is a fascinating look at the intellectual curiosity, persistence, passion, and interpretive abilities common among innovators.

Mr. Penumbra's 24 Hour Book Store

Mr. Penumbra's 24 Hour Book Store by Robin Sloan is a magical novel about the quest to find things out and the nature of friendship in the new millennium.   Its interesting cast of characters joins in the search for answers to century old mysteries and more modern questions like hard cover book or ebook in the age of the Kindle, the Nook, and the iPad all the nature while seeking to solve the mystery of what is really going on in Penumbra's Bookstore in Great Recession, entrepreneurial San Francisco.

Mr. Penumbra's 24 Hour Book Store is a good read for web designers, book lovers, seekers of traditional knowledge, the A2K crowd, typologists, book scanning enthusiast, gamers, Ruby programmers, data visualizers, googlers, virtual reality wizards, wizards, warlords, and rogues.  There is even a thread of invention and innovation woven through the tale.

Culturematic - Cultural Machines That Spur Innovation

This book was hidden in the business marketing book section in the back of the Barnes & Noble.  Right next to the books on HTML5 and CSS3, the reason for the visit to the bricks and mortar world of technical references.  (I love my ebook readers, all of them, but they generally stink for technical references, at least of the programming variety.)  Culturematic looked a bit lonely sitting among the Google Adwords for Dummies books.  So there it was, black cover with a charmingly retro font screaming about how to create and execute breakthrough ideas.  And it has a section on the creation of fantasy football.  Skip the manuals, buy the book with the colorful cover.

Grant McCracken uses the framework of new millennial cultural happenings to explain how ideas converge and evolve to enable contemporary discovery, how we explore our world.  How people are working and thinking and exploring and doing it all at one time.  Its a fascinating look at where innovation is happening, how it is happening, and how we react to it and build business models around it.  You'll be surprised.

patentECO - Environmental Friendly E-Tail


For a small additional fee . . .
Now that we have survived the official 2011 Christmas holiday shopping season, are there new clean technologies that specifically pertain to . . . online shopping?
Yes.
On March 29, 2011 Eric Brandwine and Luis Cabrera were granted US patent number 7,917,400 for “Environmentally conscious transaction determinations.” Amazon Technologies, Inc. of Reno, NV is the assignee.
This patent is a business method patent, classified in the US Patent Classification system as 705/26.8. Patents in this area cover the compilation or processing of lists (e.g., purchase orders, etc.) and are a subset of electronic shopping. Business methods patents fall within the Industry category of Way Better Patents cleantech ecosystem.
Claim 1 of the patent states:
“A computer-implemented method of enabling a user to select at least one item based at least in part upon environmental impact information, comprising:
under control of one or more computer systems configured with executable instructions, receiving a request from the user for information about at least one item available for consumption;
determining environmental impact information for the at least one item corresponding to the request, the environmental impact information for each item including environmental impact data about the physical item and environmental impact data for one or more packaging options available for the item;
and providing for display information about the at least one item based at least in part on the determined environmental impact information, wherein the user is able to base a selection of the at least one item to be included in a transaction, and at least one packaging option for the at least one item, based at least in part upon the determined environmental impact information displayed to the user before completion of the transaction.”
The patent, once implemented on Amazon’s web site, will allow customers to select options that reduce the environmental impact of each transaction. Options include the ability to purchase environmental offsets to offset the determined impact. Customers can be provided with environmental impact information determined or tracked for each item viewed, so that each customer can be informed of the incremental environmental impact of each individual when making a purchase selection. The selections and/or actions of a customer can be tracked such that environmentally friendly options and suggestions can be provided for subsequent transactions.
This is an interesting concept, but the devil is in the details. What data and analytical procedures will be used by Amazon to determine the environmental impact of transactions? Are these to be real, measurable impacts, or modeled/predicted impacts? What groups will receive the offset money paid by customers who choose that option? How will that money really be used?
Call me skeptical for now.

patentECO - The Way Better Patents View



The patentECO Clean Tech Ecosystem
In my introductory patentECO post, I referred to the clean technology ecosystem — what does this phrase mean?
Way Better Patents reviewed many definitions of “clean”, “green”, and “sustainable” technology. Some more accurately describe our view of clean technology than others, but we found that none capture key economic factors that are necessary for clean technology to provide viable products and services in a market-based economy.

Clean technology can be found across the innovative continuum.  Broadly clean tech is technology that uses less material and/or energy, minimizes waste, and lessen negative environmental consequences.  Clean tech can be found in the physical, chemical, electrical, biological, or computational disciplines.  
These technologies cover a wide spectrum of processes, products, services, and business models.  Clean tech delivers financial returns for investors, competitive prices for consumers, and profits for producers. The clean technology ecosystem is characterized by innovation that maintains a focus on efficient and productive use of natural and man-made resources in a sustainable manner — targeting human needs and desired products and services, while conserving resources and the environment so that these needs and desires may be met both now and in the future.
Clean technologies apply to agriculture, air pollution control and reduction, industry, energy, resource extraction or harvesting, transportation, and water and wastewater, and pertain to the resource inputs, processes, and supply chains that support them.
We have identified particular portions of the US Patent Classification system (USPC) and the International Patent Classification system (IPC) that cover clean technologies in these disciplines that pertain to:
  • Agriculture
  • Air,  air pollution control and reduction
  • Industry
  • Energy
  • Resource extraction or harvesting
  • Transportation
  • Water, water and wastewater
In upcoming posts we’ll review patented technologies in these areas from the standpoint of the defining aspect of the invention, and where it lies within the innovation space of that particular technology.

Welcome to patentECO


Today, Way Better Patent inaugurates our new patentECO blog.  patentECO will appear here on The Inkling.
patentECO is Way Better Patents’ ecosystem of clean technology innovation, as represented by patents issued by the US Patent & Trademark Office (USPTO), the European Patent Office (EPO), and other international patent organizations comprising the World Intellectual Property Organization (WIPO).
patentECO will review cleantech inventions and the patents that define them and the role patents play in the cleantech ecosystem.  We will review cleantech news items from an intellectual property (IP) and innovation perspective. We will focus on seven major categories within the clean technology ecosystem: air, industry; energy; water; resource extraction and harvesting, transportation and agriculture. We’ll take forays into other corners of the cleantech ecosystem as our interest leads us.
Michael Bowman, the Managing Editor of patentECO, is leading this effort.  Mike has decades of experience in clean technology, intellectual property analysis and management, innovation, and high tech knowledge management solutions.
